President of Abkhazia Raul Khajimba commented on the situation with election of judges of the Constitutional Court at a session of the National Assembly of the Parliament of the Republic of Abkhazia.
Sukhum. November 23. Apsnypress. President of Abkhazia Raul Khadjimba comments:
"The results of yesterday's vote in Parliament for the election of judges of the Constitutional Court are surprising. Some deputies without explanation, without asking a single question, vote against. Others - receive ballots and do not vote.
However, Parliament's rules of procedure provides that the deputy by secret ballot shall be obliged to vote "for" or "against.", He has no right to abstain from voting! The absence of deputy's position on such an important issue as the formation of the Constitutional Court, says a lot, including his citizenship!
As you know, in accordance with the Constitution, judges of the Constitutional Court are elected by the Parliament, on the proposal of the President, by a qualified majority. In this case, the right to propose candidates to the President of the judges of the Constitutional Court of the Republic of Abkhazia belongs to a group of at least one third of the total number of Members of the Parliament.
One of the three candidates for the Constitutional Court judges, who was not elected yesterday - Tamaz Ketsba - was recommended to me by Parliament. Paradoxically, when the Parliament recommended to the President candidacy for the post of judge of the Constitutional Court, President approved the proposal, and then the deputies themselves did not elect him.
I recall that from January 1, 2016 amendments to the Constitution, which stipulate that any proposal for amendment or revision of the Constitution may be made to the Parliament only if there is a relevant conclusion of the Constitutional Court came into force. Therefore, it is impossible to continue constitutional reforms if there will not be formed the Constitutional Court. So I want to call on the deputies for more responsible approach to the consideration of such important matters of state!"
