The new Labour Code: the prohibition of discrimination, forced labor, the priority of life and health of the worker

Representatives of the Ministry of Labour, Employment and Social Security of the Republic of Abkhazia informed the journalists about the aims and objectives of the new Labour Code.

Sukhum. February 20. Apsnypress. Madina Chagava. RA Labor Code came into force in January this year. About the basic standards and innovations of legislation at a press conference informed the representatives of the Ministry of Labour, Employment and of Social Security.
 
 Minister of Labour, Employment and Social Security of RA Ruslan Adzhba stressed that the new Labour Code is based on the norms of international law and Constitution. "The fundamental principles of this Code are: the prohibition of discrimination and forced labor, the priority of the life and health of the employee in relation to the results of production activities, etc. The new Labour Code complies with the requirements of the market economy... The document recorded equal starting rights for all workers, regardless of activity". Adzhba noted that to complete the work of the new Code is necessary to develop and adopt a number of legal acts.
 
  According to labor department head of the Ministry Dzhansuh Agrba the Code provides for monitoring of compliance with labor legislation of RA. In particular, it introduced the state inspector status. "Inspectors are given certain rights and responsibilities. This is a separate structure under the Ministry of Labour, Employment and Social Security. At the moment, there are already assigned head and two members of the inspection. Their responsibilities include: to monitor the entire territory of Abkhazia for the execution of the employment contract, to identify violations and infringements of the rights of workers and employers".
 
 Deputy Minister of Labour, Employment and Social Security of Abkhazia Karine Parshina reported on a number of innovations of the Code. For example, the new document stipulates that citizens can work not only in enterprises which have the status of a legal entity, but also in individuals organizations. "In all cases, the employer is obliged to conclude an employment contract with the employee. In this case the employer, who is not an individual entrepreneur must register the contract in the local government. Within 5 days of work employment must record for the calculation of seniority".
 
Parshina also explained the procedure for employment of students who combine work and training. She noted that students have the right to work. "To visit certain exams and lectures they are given the right to obtain study leave. However, holiday pay paid in the amount of 50% of salary ", - Parshina said.
